Terms of Service

PRO-STACK ("we," "us," "our") is a local service directory and scheduling platform connecting residents with trusted local service providers nationwide.

PRO-STACK is a product of POC-It (Professionals Online Content). POC-It is the parent company and operator of the PRO-STACK platform. All legal agreements, billing relationships, and data responsibilities described in these Terms are held by POC-It on behalf of PRO-STACK.

PRO-STACK provides:

• A directory of local service providers for community residents
• A scheduling and booking system for appointment requests
• Route optimization tools for service providers
• A messaging system between residents and providers
• Review and rating capabilities

PRO-STACK is a marketplace platform. We facilitate connections between residents and independent service providers. PRO-STACK is not a party to any service contract between a resident and a provider. PRO-STACK does not employ, supervise, train, or certify providers. All listed providers are independent businesses or individuals operating on their own behalf. Service quality, safety, licensing, insurance, and execution responsibility rest entirely with the provider and the customer — not with PRO-STACK or POC-It.

Residents: Anyone may browse the directory, contact providers, submit booking requests, and leave reviews. No account is required to browse; an email address is required to complete a booking.

Service Providers: Service providers may register directly at pro-stack.us. Listings go live upon registration and completion of the required profile information. PRO-STACK and POC-It reserve the right to edit, suspend, or permanently remove any listing at their sole discretion, including for violations of these Terms, fraudulent activity, or failure to maintain an active subscription after the free trial period.

Age Requirement: You must be at least 18 years old to use PRO-STACK or submit any content.

Free Trial: New providers receive a 14-day complimentary free trial. A valid payment method is required to start the trial. Your card will not be charged until the trial period ends.

Basic Listing Plan: $14/month. After the 14-day trial, providers must maintain an active Basic Listing subscription to remain listed. Includes directory listing, contact requests, in-app messaging, and PRO-STACK scheduling tools.

Priority + Instant Jobs Plan (Optional Upgrade): $29/month — includes everything in Basic Listing plus priority ranking in all search results, live map pin, real-time availability badge, instant booking access, and featured placement. Cancel anytime.

Plan Terms: Both plans are billed monthly via Stripe. There are no annual commitments. Providers may upgrade, downgrade, or cancel at any time. Upon cancellation, the listing is deactivated immediately.

Payments: All subscription payments are processed securely through Stripe. PRO-STACK (via POC-It) never stores, handles, or has access to your full credit card or banking information. Stripe's own Terms and Privacy Policy govern payment processing.

Placement & Ranking: Search result order is determined by PRO-STACK's ranking algorithm, which considers subscription tier, rating, review count, activity score, location relevance, and profile completeness.

Cancellation: Subscriptions may be cancelled at any time. No refunds are issued for partial months. The listing is deactivated immediately upon subscription cancellation.

How Booking Works: Residents may submit a service request through a provider's PRO-STACK profile. If the provider has set their availability, the system offers available time slots based on that schedule.

Auto-Confirmation: When a provider marks themselves available, bookings during those hours are automatically confirmed. Both parties receive an email confirmation with a calendar invite (.ics file).

Conflict Prevention: Customer-facing bookings include a server-side check to prevent two customers from booking the same provider at the same date and time. If a slot is taken between when it was shown and when the booking is submitted, the customer is notified and prompted to choose another time. Providers who manually add their own schedule entries within the PRO tool have UI-level time conflict detection — overlapping manual entries are shown a warning and blocked from saving when a conflict is detected.

Cancellations: Either party may cancel a confirmed booking at any time. Cancelled bookings remain visible in both parties' history (a soft cancel) — they can be removed from view by the individual user at any time. PRO-STACK is not liable for any losses arising from a cancellation.

No Service Guarantee: A confirmed booking is a scheduling confirmation only — not a binding service contract between the provider and resident.

By submitting a booking request or contact form on PRO-STACK, you consent to receive transactional emails including booking confirmations, cancellation notices, 24-hour reminders, and scheduling updates.

Providers who register on PRO-STACK consent to receive booking notifications, trial/subscription reminders, and platform updates related to their listing.

Transactional emails cannot be opted out of while you have an active booking or subscription. Email delivery is powered by SendGrid (Twilio). Sender address: noreply@poc-it.co.

We share limited data only with the services that power PRO-STACK:

• Stripe — to process subscription payments (they handle all card data)
• SendGrid (Twilio) — to send you emails
• ProStack Platform Services — the secure cloud infrastructure that hosts PRO-STACK
• Law enforcement — only if required by law to protect user safety

Specifically:

• Session cookies — keep you logged in while you use the site
• Local storage — remember saved providers and preferences (saved providers list, city area selections)
• Location/area selection — used only to match you with nearby providers. We use neighborhood/area selections you enter, not your device's live GPS coordinates unless you explicitly tap "Use My Location"
• No advertising cookies — we do not use Google Ads, Facebook Pixel, or any cross-site tracking tools

If you decline cookies: The browsing directory is still fully accessible. The only limitation is that your saved providers, area preferences, and session state will not persist between visits. No core functionality requires cookies — declining them does not degrade the search or contact experience.

Residents may submit reviews for any provider they have contacted or booked through PRO-STACK. By submitting, you confirm that you have personally used the provider's services and that your review is honest and accurate. Reviews are submitted to a moderation queue and are manually reviewed by PRO-STACK staff before being published. PRO-STACK reserves the right to reject, remove, or flag any review found to be fraudulent, abusive, or in violation of these Terms. Approved reviews are final unless new evidence of fraud is presented.

PRO-STACK PRO includes a nearest-neighbor route sorter (reduces backtracking based on job GPS coordinates), customer management, availability calendar, smart messaging, performance analytics, and an AI-powered schedule importer (uses GPT-4o to extract appointments from uploaded photos). PRO tools are provided "as is."

Estimates and projections: Fuel and time savings shown in the Route Optimizer are model-based estimates using average fuel cost and job duration inputs. They are not guarantees of actual cost savings. Weather forecasts are sourced from Open-Meteo and are for planning purposes only — PRO-STACK is not responsible for schedule impacts from weather changes. Booking slot suggestions are availability-based, not AI-generated.

You agree not to: submit false or fraudulent information, post spam, harass users, scrape PRO-STACK content, circumvent the booking system, use PRO-STACK for any unlawful purpose, or submit fake reviews.

PRO-STACK provides its services "as is" without any warranties. We do not warrant that providers are licensed, insured, or qualified for any particular job. PRO-STACK is not responsible for the quality, safety, timeliness, or outcome of any services performed by listed providers.

To the fullest extent permitted by law, PRO-STACK, POC-It, and their owners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of PRO-STACK, any service provided by a listed provider, a cancelled appointment, or reliance on any information displayed on the platform.

We may update these Terms from time to time. When we do, we'll update the effective date at the top. Continued use of PRO-STACK after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Virginia, without regard to its conflict of law principles. All disputes not resolved by arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in Virginia.

Informal Resolution First: Before filing any claim, you agree to contact us at support@pro-stack.us and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, all disputes arising from or related to these Terms or your use of PRO-STACK shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA) or a mutually agreed equivalent. The arbitration shall take place in the jurisdiction of POC-It's principal place of business, or remotely by mutual agreement.

Class Action Waiver: YOU AND PRO-STACK EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative action.

Exceptions: Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent unauthorized use of intellectual property or misuse of the platform.
